Payment Policies and Disclaimers

These terms apply to all individuals submitting personal and payment information via the Walsh Property Service online payment portal. By selecting the “Pay Now” button, you confirm that you have read, understood, and agree to the following terms, and you authorize Walsh Property Service to process your payment via a secure third-party provider.
1. Use of Third-Party Payment Processor
Walsh Property Service uses Elavon Canada Company (“Elavon”), a trusted and PCI DSS-compliant third-party payment processor, to manage all online credit card transactions.
When you proceed with payment:
- Your personal and payment details—including name, address, phone number, email, and credit card information—are securely transmitted to Elavon for processing.
- Walsh Property Service does not collect, store, or have access to your full credit card number or CVV.
Please note:
- Elavon is an independent service provider with its own Terms of Use and Privacy Policy, which you are encouraged to review.
- By submitting your payment, you acknowledge Elavon’s role and consent to their privacy practices.
- Walsh Property Service is not responsible for Elavon’s operational issues, system errors, or service disruptions unless required by law.
2. Collection and Use of Personal Information
Walsh Property Service collects only the personal data necessary to:
- Process your payment,
- Respond to inquiries,
- Comply with legal obligations.
Information collected includes:
- Full name
- Email address
- Mailing/Billing address
- Phone number
- Payment amount and reference number
Your information is managed in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and relevant Ontario privacy legislation.
We do not sell or share your data with third parties, except:
- As necessary to complete your transaction (e.g., with Elavon),
- As required by applicable law.

3. Accuracy of Information
You are responsible for providing accurate and complete information when making a payment.
Failure to do so may result in:
- Delayed or unsuccessful payment processing,
- Additional administrative follow-up.
Walsh Property Service is not liable for any loss or inconvenience caused by incorrect or incomplete information. If you discover an error after submission, please contact us immediately using the contact details above.
4. Limitation of Liability
To the extent permitted by law, Walsh Property Service and its affiliates (including directors, employees, and contractors) are not liable for:
- Processing delays, errors, or third-party failures,
- Unauthorized access to your data beyond our control,
- Technical issues, system outages, or fraudulent activity involving Elavon or other intermediaries,
- Any incidental, indirect, or consequential damages arising from the use of this payment system.
This clause does not affect your consumer rights under the Consumer Protection Act, 2002 (Ontario) or any other applicable legislation.
5. Consent and Agreement
By selecting the “Pay Now” button, you:
- Confirm you are authorized to make this payment;
- Acknowledge the accuracy of the information submitted;
- Consent to Elavon’s role as a third-party processor and agree to their Terms and Privacy Policy;
- Accept the collection and handling of your personal information in compliance with applicable privacy laws (PIPEDA, Ontario statutes);
- Agree to resolve any concerns, errors, or disputes through prompt communication with Walsh Property Service;
- Acknowledge that these terms are governed by the laws of Ontario and applicable Canadian federal law, with disputes to be settled in Ontario jurisdiction.
If you do not agree with these terms, please do not proceed with payment.
